Preliminary Remarks
This document contains, on one side, the conditions of use (hereinafter "Rules of Use") of the www.laboratorihur.com Website (hereinafter also the "Website“) and, on the other, the General Conditions of Sale (hereinafter "General Conditions") for the purchase of products.
The access to and use of the Website is allowed only to the "Consumer" Customer (B2C). The Consumer Customer, according to art.3 of the Consumer Code, is "a natural person who is acting for purposes outside of his/her entrepreneurial, trade, craft and professional practice".
The contracts entered with Laboratori Hur through the Website are governed by these General Conditions. The language for concluding the contract, in addition to Italian, is English.
The Rules for Website Use and the applicable General Conditions of Sale are those posted on theWebsite at the time of access and/or purchase order. Any changes and/or updating of the Rules of Use and General Conditions of Sale shall be valid and effective as soon as they are posted on the Website.
The purchase of products on the Website is possible with or without registration. The access to the Website and the purchase of products is permitted only to those who have reached legal age.

Rules of Use
By accessing the Website, Customers explicity agree to observe all the terms and conditions of use contained in this document.
Laboratori Hur, as the Website owner, reserves the right to refuse or limit the use of the Website should the Customer not agree to and not intend to observe these Rules of use.
Access to the Website provides the Customer with information about the products offered, along with the possibility to purchase them.
Registration with the Website
Regustration with the Website, by filling in the relevant form, is free of charge.
Registration allows the Customer to access a special area providing the following infornation and to be able to perform the following activities:

To view the list of orders placed;

To view and modify the invoicing address (if needed) and delivery address;

To view and modify the information about one's account;

To agree to and view the "Loyalty Points Card".
Furthermore, when logged in, the Customer will be able to place the order more quickly, because the shipping and invoicing data will be pulled from his/her account.
At any time, the Customer shall be able to demand the disconnection and deletion of the account through the specific link on the Website or by contacting us directly at the email address info@laboratorihuir.com.
Laboratori Hur reserves the right to suspend or terminate a Customer's Account at any time and without notice should it establish that irregularities in accessing the Website and/or in the orders placed have been committed.
Ownership – Copyright & Trademark
All content on the Website- as way of example: documents, images, videos, fonts, design, music, software, codes and script formats, trademarks and/or any other distinguishing mark- is either owned by Laboratori Hur and/or in its lawful possession, All content on the Website is protected by Copyright. Any reproduction, alteration, transmission, publication or redistribution to third parties, for commercial purposes, is strictly prohibited. In any case, it is strictly prohibited to users to use the content or trademarks on the Website for any purpose other than those related to the use of the services offered by the Website.
Disclaimer of Liability
All information posted on the Website has the purpose of providing a service to Customers. In any case, Laboratori Hur declines any liability for any possible inaccuracy and/or errors contained in the information provided, for which immediate correction, upon reporting, shall follow.
Furthermore, Laboratori Hur reserves the right to make corrections and changes to the Website, as well as to the terms and conditions hereby presented as necessary without giving prior notice.
The Customer shall observe the terms hereby presented, periodically checking for updates, changes and corrections.
Laboratori Hur declines any liability for any malfunctioning in the disabling of cookies on the user's browser.
Italian Laws
Customers accessing the Website declare to agree that all matters regarding the use of the www.laboratorihur.com Website shall be governed by the laws in force in the Italian State. Any dispute with a Consumer Customer (B2C) arising from the interpretation, execution or termination of these Rules of Use, according to art.66 bis of the Consumer Code, shall be settled by the competent court with jurisdiction in his/her place of residence or domicile if located on the Italian territory.
Laboratori Hur does not guarantee the compliance of the Website's content with the laws in force in other countries. The access to the Website from countries where its content is classed as illegal is explicitly forbidden. Customers Users who decide to access the Website from such countries shall be fully aware of the legal consequences and sanctions they will incur and they shall be held solely liable for the compliance with local laws.
General Conditions of Sale
1. Product Information
Each product shown on the Website shall be accompanied by an Information Sheet describing its main characteristics. Laboratori Hur reserves the right, in any case, to modify the Information Sheets without prior notice.
The pictures of the products on the Website are for mere demonstration purposes. Although they represent the products on sale as accurately as possible, the images and colors might differ from the real ones, also because of the different configuration of the Customer's computer or its malfunctioning. For the purpose of the purchase contract, the product description contained in the Information Sheet on the Website at the time of purchase shall be considered valid.
The images on the www.laboratorihur.com Website are owned by and/or in the lawful possession of Laboratori Hur. Any use of such images without Laboratori Hur's written consent shall be prosecuted in accordance with the law.
2. How to Order
The Customer shall add the Product to the "Shopping Cart" which can be viewed and modified without any obligation to purchase it. After adding the products to the Shopping Cart, in order to complete the order procedure, the Customer shall select the " Go to Check Out" virtual button where he/she shall provide all personal data, delivery data as well as mode of payment and request of invoice if needed.
Only when he/she has provided all data requested on the Order Form, the Customer shall complete the procedure by selecting the "Place Order" virtual button that will allow him/her to access the summary sheet before proceeding to the payment and final forwarding of the order.
By forwarding the order, the Customer acknowledges and declares that he/she has looked over all the information provided during the purchase procedure and agrees in full to the General and payment conditions transcribed.
The forwarding of the order from the Website constitutes an offer for the purchase of products subject to receipt by Laboratori Hur of the payment of the price, taxes and shipping fees as shown on the summary sheet.
Laboratori Hur reserves the right to accept the order received and to confirm the order preparation stage via email within an ordinary period of 2-3 working days up to a maximum of 15 days in extraordinary periods. Should the products ordered not be available within over 15 working days or, for some reason, should it not be possible to fill the order as per the Customer's request, the Customer shall be promptly informed at the emal address provided. In any case, the company reserves the right to a longer delivery time, in particular, during holiday periods and/or in case of excepitonal events preventing the company to deliver within the ordinary above-mentioned period of time ( pandemics and/or force majeure).
The contract agreed upon between Laboratori Hur and the Customer shall be concluded with the acceptance of the order. Such acceptance shall be communicated to the Customer via an order confirmation email containing a reference to these General Conditions, to the order number, the order's date and time, shipping and invoicing ( if needed) data provided by the Customer, the chosen modes of payment as well as the list of Products ordered along with their basic characteristics, the total price, including delivery charges. The Customer shall verify the correctness of the data provided at the time of order and inform Laboratori Hur about any mistakes.
3. Prices
The prices of the products on the Website are all in Euros and are inclusive of all taxes and charges to be paid for in Italy. In case of a foreign destination, any tax and charge to be paid for in the country of destination shall be charged to the Customer.
Laboratori Hur reserves the right to modify the price of its Products at any time. Any variation shall become effective from the date it is posted on the Website. It is understood that the Customer shall be charged the price that is effective at the time of Order even in case of subsequent variations.
In addition to the purchase price are, if applicable, the delivery charges as shown on the order form.
4. Modes of Payment
The modes of payment accepted by Laboratori Hur are:

Credit Card: information regarding the Customer's Credit Card shall be acquired and handled directly by the Managers of the Credit Card service;

PayPal;

Cash on delivery;

Advance Bank Transfer.
In case of prolonged unavailability of the product ordered ( over 15 working days, except in cases of force majeure), Laboratori Hur shall refund the customer for the total amount of the order through the mode of payment chosen by the Customer at the time of Order.
5. Invoicing
It is the Customer's responsibility to request the invoice at the time of order and provide the data required. Once the invoice has been issued, no further changes can be made. In case of incorrect data, Laboratori Hur reserves the right not to issue the invoice requested.
6. Shipping Modes
The orders of products available shall be shipped within 2-3 working days following the date of the order, unless the goods are unavailable or in cases of force majeure.
The Products purchased on the Website shall be delivered to the address provided by the Customer during the puchase procedure in the "Shipping Data" field and shall be accompanied by the freight documents.
Laboratori Hur ships to all EU countries.
Estimated delivery time of products is to be understood as following the working days required for the order preparation, after which the estimated delivery time shall be:
Italy: 2-3 working days
Europe: 2/5 working days
Delivery time is provided purely as an indication. In any case, Laboratori Hur reserves the right to postpone the delivery in the event of cases of force majeure.
Laboratori Hur is not accountable for any delay due to customs clearance and inspection, or in the event of cases of force majeure beyond the company's control. .
In case of repeated impossibility of delivery due to the Customer's absence and/or wrong address, the product shall remain in storage at the Courier for five days following the failed delivery attempt. The Customer shall be informed about the above-mentioned and, in the event of non-collection, according to the courier's instructions, the order shall be cancelled. In that case, delivery charges ( including the cost of return shipping) and any customs duty shall be charged to the Customer and deducted from the refund.
7. Product Verification
Upon delivery, the Customer shall verify that the packaging is not damaged or otherwise altered and that the number of items delivered corresponds to the number shown on the freight document.
In the event of damaged packaging or incorrect number of items, the Customer shall immediately report it to the Courier, by accepting the delivery with reserve, and immediatley inform Laboratori Hur at the address: info@laboratorihur.com.
Once signed the Freight Document without any reserve, the Customer shall not raise any objection regarding the packaging's and the product's external appearance.
Should the Customer notice the Product's non-conformity, he/she shall inform Laboratori Hur within five days of reception providing also, if possibile, photographs and/or videos of the non-compliant product. Should it be possible to detect the product's non-conformity by looking at the photos or videos, Laboratori Hur shall replace the product with another. On the contrary, the Customer shall ship the product back to Laboratori Hur for the necessary check. Should the product's non-conformity not be detected, shipping expenses shall be borne by the Customer.
8. Shipping Costs
Shipping costs shall be borne by the Customer, except in the event of the Company's explicit commercial policies which shall be further clarified at the time of order placing.
9.CANCELLATION OF THE ORDER
If the Customer has successfully placed the order, he/she may cancel the order only up until it has not entered the shipping process yet. In any case, this is without prejudice to the right of withdrawal as described in the following paragraph.
10. Right of Withdrawal ex art. 52 Consumer Code
According to art.52 and following of the Consumer Code, the "Consumer" Customer is entitled to withdraw from the Contract within 14 days of reception of products, without offering any explanation.
The Customer who intends to make use of the right of withdrawal- within 14 days of reception of goods- shall provide wirtten communication to Laboratori Hur by means of certified mail letter with advice of delivery, fax, or electronic mail at the address: info@laboratorihur.com.
In the event of exercise of the right of withdrawal, Laboratori Hur shall inform the Customer, at the email address provdided at the time of order, about the address to which the products shall be returned. The Customer- at his/her care and expense- shall return the products within 15 (fifteen) days of the communication sent to Laboratori Hur, taking care of the products' proper packaging.
Considering the nature of the products marketed by Laboratori Hur, please note that the right of withdrawal is explicitly excluded, according to art.59 of the Consumer Code, for goods that may perish or quickly exceed their expiry date and/or for sealed goods that cannot be returned for hygienic or health-protection related reasons and have been opened after delivery. In view of the above, the right of withdrawal shall be granted only in the event of products returned intact in their original packaging without any signs of opening.
Upon reception of products, Laboratori Hur shall verify the packaging's integrity and the product's proper preservation condition. In the event of anomalies, the legitimacy of the right of withdrawal may not be recognized. In the event of legitimate withdrawal, as soon as the product's integrity has been verified, Laboratori Hur shall refund the Customer the amount paid for the product purchased through the same mode of payment used at the time of order.
11. Sales Ban
The purchase of products on this Website is intended for personal use. It is explicitly forbidden to sell products purchased through the Website to third parties. Should Laboratori Hur ascertain anomalous purchase flows, it may refuse to fill the orders that follow, reserving the right to take legal action against the purchaser for the unauthorized marketing of products.
12. Governing Law, Dispute Resolution and Place of Jurisdiction
The sales contract between Laboratori Hur and the Customer is concluded in Italy and governed by the Italian Law.
According to art.14 of Regulation 524/2013, the Customer, in the event of issues and/or disputes regarding the order, can file a complaint through the European Union's ODR platform at the follownig link: https://webgate.ec.europa.eu/odr. Through this platform, the Customer shall receive all the necessary assistance in making an attempt at an extrajudicial settlement of any dispute arising from online sales contracts.
In any case, disputes arising from the interpretation, execution or termination of these General Conditions or of single purchase orders by the "Consumer" Customer, according to the Consumer Code, shall be settled by the competent court with jurisdiction in his/her place of residence or domicile if located on the Italian territory; in any other case, the place of jurisdiction is Florence.
13. Mode of Contract Storage
We hereby inform the Customer that this contract shall be stored in digital form on the company's servers in cloud computing with all the required guarantees in terms of privacy and safety.
